A marketplace such as Jememo.com is intended to foster fair and ethical practice within its membership and is only as trustworthy as its members. Therefore, every Jememo member, in addition to agreeing to follow Jememo’s Terms of Service and other policies, agrees to abide by the following marketplace community guidelines:

General Conduct

I will maintain a professional and cordial tone with my fellow members, understanding that the core purpose of Jememo is to assist fellow jewelers and add goodwill to the retail jewelry industry.

I will affirm and warrant that I am an owner or employee of a legally-constituted business in the gem and jewelry industry and that I have accurately represented all updated business and contact information. If anything changes in my status as an active jewelry business and/or my ability to meet my financial or professional obligations, I will inform Jememo immediately.

I will engage in safe online conduct, handling fellow members’ information with discretion and care. Safety guidelines include but are not limited to:

-       communicating with fellow members through our website messaging feature to ensure there is a record of correspondence;

-       using a secure payment method backed up by a credit card or bank account and not a debit card;

-       assigning a strong password to your account, changing it frequently and not sharing that password with anyone or any third-party website;

-       carefully reviewing each item listing and photos before purchasing outright, asking the loaner/seller any questions before making payment;

-       reporting to Jememo any questionable or prohibited items;

-       conducting transactions through Jememo.com and its affiliated payment and shipping portals to ensure objective records of transactions;

-       refraining from giving out personal financial, payment or contact information to another user, especially if the user is asking for the information outside of Jememo.com;

-       routinely checking financial statements for questionable activity and reporting unauthorized charges immediately.

I will engage in legal conduct, listing only jewelry items that are legal to sell and legal to ship — under federal, state and local law. Specifically, I will only loan or sell items that I legally, fully own and refrain from the following prohibited conduct:

-       encouraging payments or donations outside of the scope of the Jememo transaction(s);

-       asking a member to review another member before the transaction is complete;

-       using Jememo for the purpose of money laundering or otherwise using Jememo to buy and sell from myself, or to send funds to myself;

-       using Jememo for any illegal purpose or in violation of any local, state, national, or international law or regulation; violate, or encourage others to violate, any right of a third party, including by infringing or misappropriating any third-party intellectual property right;

-       posting, uploading, or distributing any content that is unlawful, defamatory, libelous, inaccurate, or that a reasonable person could consider objectionable, profane, indecent, pornographic, harassing, threatening, embarrassing, hateful, offensive or otherwise inappropriate;

-       communicating, posting, listing, or soliciting any items or engaging in any conduct that glorifies hatred, violence, intolerance or discrimination based on religion, sexual orientation, gender, race, political or ethnic background;

-       interfering with security-related features of Jememo, including by: (a) disabling or circumventing features that prevent or limit use or copying of any content; or (b) reverse engineering or otherwise attempting to discover the source code of any portion of Jememo except to the extent that the activity is expressly permitted by applicable law or regulation;

-       interfering with the operation of Jememo or any user’s enjoyment of Jememo, including by: (a) uploading or otherwise disseminating any virus, adware, spyware, worm, or other malicious code; (b) making any unsolicited offer or advertisement to another user of Jememo; (c) attempting to collect, personal information about another user or third party without consent; (d) interfering with or disrupting any network, equipment, or server connected to or used to provide Jememo, or violating any regulation, policy, or procedure of any network, equipment, or server; use any robot, spambot, spider, crawler, scraper or other automated means or interface not provided by us to access Jememo or to extract data; or (e) posting content containing warez or links to illegal sites.

-       performing any fraudulent activity including impersonating any person or entity, claiming a false affiliation, accessing any other Jememo member account without permission, or falsifying my age, date of birth or other information;

-       selling or otherwise transferring the access granted under these guidelines or any right or ability to view, access, or use any content.

I am aware that the role of Jememo is to connect professional jewelers for their mutual benefit and that Jememo itself does not warrant or guarantee any member’s product or conduct and that I will indemnify and hold Jememo harmless from any liability resulting therefrom.

I am aware that my violation of any of Jememo’s rules or policies (including non-enumerated undesired conduct) may result in the temporary or permanent suspension of my membership at Jememo’s sole discretion.

Borrower & Buyer Guidelines

I will request to borrow only those items that I believe I will be able to sell at retail.

I will thoroughly inspect all borrowed and/or purchased jewelry items immediately upon receipt and promptly inform the loaner/seller of any previously undisclosed defect or damage that I discover.

I will employ the utmost care while borrowing items on memo, immediately reporting and fully paying for any damage, loss or theft that incurs while those items are in my possession.

I will inform the loaner of any sale of a borrowed memo item and pay for the item in full within 30 days of the sale.

I will return unsold borrowed memo items on the exact date that they are due back to the loaner in the same condition they were received. If I am unable to make a timely return, I will contact the loaner immediately and make arrangements for the soonest possible return, understanding that such an arrangement may incur late fees.

I understand that my failure to return a borrowed item on time and in the same condition it was received may result in that item being deemed purchased and the loaning member may issue an invoice, immediately due and payable.

Loaner & Seller Guidelines

As detailed above, all items that I list on Jememo are legal items owned by me and the selling of any item will not violate any local, state or federal regulations.

All representations that I make in a listing pertaining to a jewelry item’s elements, composition, age, authenticity, appearance, treatment, origin, value and condition are accurate, correct and complete to the best of my knowledge.

All images I upload will be of the same item actually being offered for loan or sale.

I will either accept or reject a member’s request to borrow within three (3) business days of the request date.

I will refrain from the following prohibited conduct:

-       Listing items without the intent to sell

-       Using another member's photos or words without their consent

-       Listing another user’s personal information in a manner other than specified by Jememo

-       Listing an item that promotes hatred, violence or discrimination

I will not loan or sell any prohibited and/or illegal item, including but not limited to:

-       Any product, service, transaction or activity that in general:

-       Violates any law or government regulation, or promotes or facilitates such action by third parties;

-       Is fraudulent, deceptive, unfair or predatory;

-       Causes or threatens to damage Jememo’s reputation;

-       Violates the terms of any bank, card or electronic funds transfer network;

-       Results in or creates a significant risk of chargebacks, penalties, damages or other harm or liability

-       Drugs including:

-       Illegal drugs or narcotics

-       Prescription medicines or devices, pharmaceuticals, or behind the counter drugs

-       Products, tools, or services specifically offered or intended to be used to create or use drugs

-       Grow ingredients for drugs (such as seeds for cannabis plants)

-       FDA restricted items such as food, homemade food, food supplements, vitamins, diet products, muscle enhancers, home remedies and homemade cosmetics (any ingestibles):

-       Listings or items descriptions that offer miracle cures such as “anti-aging”, “cancer protection”

-       Listings that make false health claims or misuse terms (such as “virus”, "epidemic")

-       Items that contain cannabidiol (CBD)

-       Inflated prices where listings attempt to profit from tragedies and disasters (such as “paradise fire”, “coronavirus outbreak” etc.)

-       Stolen goods:

-       Note: If a purchased item is reported as stolen, a demand for return may be received from the victim or another party, and the item may be confiscated according to the regulations of the Code of Criminal Procedure (Act no. 131 of 1948).

-       Counterfeit goods or goods infringing on a third party's intellectual property rights:

-       Listings of non-brand, non-genuine, imitation, fake, or replica

-       Items in violation of a copyright, including handmade, or other items with copyrighted characters, brand logos, etc.

-       Note: For brand-name products, serial numbers or receipts must be available when listing the item.

-       Weapons including:

-       Firearms and firearm parts; including airsoft and bb guns

-       Knives such as switchblades, butterfly knives, knives that are concealed or hidden within other objects, or are made of materials that cannot be detected with a metal detector

-       Explosives or military ordinance

-       Self defense weapons

-       Alcohol

-       Tobacco products:

-       Cigarettes

-       E-cigarettes, e-hookahs, or other vaporizing instruments that contain nicotine or are associated with tobacco or nicotine usage

-       Vaporizing liquid without nicotine

-       Items used for identity theft (such as account credentials, user login information, and/or account access codes)

-       Items that are a safety hazard

-       Note: Flammable or combustible liquids and any other items that require special mailing or handling instructions must be sent using the ship on your own option.

-       Products designed to circumvent copyright protection techniques or otherwise facilitate the unlicensed use of copyright materials (such as "mod chips" to break the encryption on game computers to allow the playing of unlicensed game copies)

-       Age restricted products or products that require a legal approval, seller/buyer registration or licenses to be sold

-       Gambling, including using this service for raffles and mystery purchases

-       Financial products and services such as:

-       Bonds, securities, warranties and insurance

-       All currency in circulation of any denomination except collectibles

-       Precious metals including bullion or bars

-       Buying and selling gift cards or prepaid cards

-       Live animals or trafficked materials (such as ivory or shark fins)

-       Any item that contains a computer virus, malware, or spyware

-       Digital items - any items requiring a download such as Ebooks, PDF files, user generated content (UGC) or items for online games

-       Humans, human body parts, organs, cells, blood, body fluids, and items that are soiled with human materials such as used underwear

-       Explicit items:

-       Sexually explicit items such as sex toys and fetish items

-       Offensive listings:

-       Items, listings, photos or content that promote or glorify hatred, violence, racism or discrimination aren't allowed (determined at Jememo’s discretion).

Member Reviews

I will leave honest reviews of fellow Jememo members for every transaction in which I participate and complete within three (3) days of every completed transaction.

I will attempt to resolve any issues directly with fellow Jememo members with whom I transact prior to leaving a negative review.

Repeated failure to review a fellow member in a timely fashion may result in the temporary suspension of my account.

Shipping

When shipping items for loan, purchase or return, I will deem each item “fragile” and pack each item accordingly and protectively to ensure safe delivery. I will make sure to use the smallest box possible for the item and extra cushioning. I will use a cardboard box sturdy enough to protect items while in transit. If there are multiple items, I will add at least one (1) inch of packaging between items, individually wrapping each item.

I will fill in all the empty space so the item doesn’t move and, upon closing the box, will tape over every opening on the package.

I will insure all items being shipped at their full replacement value per the listed Jememo wholesale price.

For shipping, I will select the proper weight class, ensuring that the package meets all dimension requirements, and affix the appropriate shipping label, having paid the required shipping in full.

I will not ship any hazardous material.

I will maintain records of all valid tracking numbers for packages shipped by me and will not provide invalid tracking information.
